Morgan & Bley’s broad commercial law practice includes the areas of commercial litigation, commercial transactions, bankruptcies and reorganizations, and related appeals.

Commercial Litigation

Morgan & Bley represents individuals, businesses, and financial institutions in a wide variety of commercial litigation in both federal and state courts. Our cases include breaches of contract and fiduciary duty, shareholder and partnership disputes, post-judgment supplementary proceedings, fraud, fraudulent conveyance, and RICO actions. Our attorneys appear in state and federal courts across Illinois and New York.

Bankruptcies & Reorganizations

Morgan & Bley has extensive experience representing parties within the bankruptcy context. What differentiates Morgan & Bley from many other attorneys who handle bankruptcies is that we do not see bankruptcy as the solution to every instance of financial difficulty. While we believe bankruptcy to be an important tool, meeting with our attorneys can be as much about formulating strategies to keep you out of bankruptcy as helping to put you in it. Because we also have experience with non-bankruptcy work, we recommend bankruptcy for our clients only after taking a holistic approach to their needs and deciding it’s truly the best option.

In addition to representing parties in Chapter 7, 13, and 11, as well as out-of-court workouts, Morgan & Bley has extensive experience representing clients in associated litigation such as preference, avoidance, fraudulent conveyance, and dischage and dischargeability actions, including at the appellate level. Morgan & Bley has represented everybody involved in the bankruptcy process: debtors, creditors, trustees—even other attorneys in disciplinary-like proceedings brought by the U.S. Trustee.

Commercial Transactions

Morgan & Bley provides a broad spectrum of services for its clients’ commercial needs. In addition to in-court litigation, Morgan & Bley assists with complex transactional matters , such as real estate closings, commercial agreements, corporate governance, and general corporate representation, in a wide-range of industries.

Trial & Appellate Work

In addition to day-to-day litigation, Morgan & Bley has substantial experience in trial and appellate work, including to Seventh Circuit, to the Illinois Appellate Court, and bankruptcy-related appeals to various district courts.

The attorneys at Morgan & Bley, Ltd. are tough litigators who have never shied away from a new challenge, even if outside of their primary legal field. In 2000, Morgan & Bley, Ltd. represented over a dozen police officers in litigation against the Highland Park Police Department, alleging various acts of discrimination. The matter was the topic of an NBC­TV Dateline program, on which Mr. Morgan appeared. The lead plaintiff, Rodney Watt, also testified before the Constitution Subcommittee of the Senate Judiciary Committee on the topic of Racial Profiling by Law Enforcement on March 31, 2000.
